1. Introduction
Welcome to ABC Emergency ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our tow truck marketplace platform ("Service"), accessible via our website or mobile application ("Platform"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Service.

2. Service Description
Our Platform provides a marketplace that connects customers ("you" or "Customer") with independent tow truck operators ("Drivers"). The Service allows Customers to request towing services, which are then fulfilled by Drivers. We facilitate the transaction by collecting payment on behalf of the Driver.

3. Use of the Service
- You must be at least 18 years old to use our Service.
- You agree to provide accurate and complete information when creating an account and requesting services.
- You are responsible for maintaining the confidentiality of your account login details and for all activities that occur under your account.
- You agree not to use the Platform for any unlawful or fraudulent activities.

4. Independent Operators
- The Drivers on our Platform are independent contractors and not employees or agents of ABC Emergency.
- We do not guarantee the quality, safety, or availability of the towing services provided by the Drivers.
- Any disputes or issues with the service should be resolved directly between you and the Driver, although we will assist in facilitating communication if necessary.

5. Payments
- Payments for services are processed through our Platform. You agree to pay the full amount specified at the time of booking.
- We may use third-party payment processors to facilitate transactions. By providing your payment information, you authorize us to charge the specified amount.

6. Refund Policy

Refund Eligibility
You may be eligible for a refund under the following circumstances:

- Service Not Provided: If the tow truck operator fails to arrive at the agreed location or does not provide the requested service, you are entitled to a full refund. This does not apply if the service was canceled by the customer after the tow truck was dispatched.Service Delayed: If the tow truck operator arrives more than [X minutes/hours] late without prior notification and the delay results in a significant inconvenience, you may be eligible for a partial refund. The exact amount will be determined on a case-by-case basis.

- Service Quality: If the service provided is significantly below the expected standard (e.g., damage to your vehicle caused by the operator's negligence), you may be eligible for a partial or full refund. This will require an investigation, and any refund will be issued after the resolution of the investigation.

- Incorrect Charges: If you were charged incorrectly or for a service you did not receive, you will be eligible for a full refund of the incorrect amount.

Non-Refundable Situations
Refunds will not be issued under the following conditions:

- Customer Cancellation: If you cancel the service after a tow truck has been dispatched, you will not be eligible for a refund. This is because the independent operator has already committed their time and resources.

- Disputes with Operator: Our marketplace connects you with independent tow truck operators, and while we strive to ensure the quality of service, disputes related to service quality should be resolved directly with the operator. We will assist in facilitating communication but are not liable for the operator's actions.

- Change of Mind: If you decide not to proceed with the service after the operator has arrived, no refund will be issued.

How to Request a Refund
To request a refund, please contact our customer support team within 48 hours of the incident. You will need to provide the following details:

- Your order number
- A detailed description of the issue
- Any relevant photos or documentation

We will review your request and respond within 2 business days. If your request is approved, the refund will be processed within 14 days, and the funds will be returned to your original method of payment.

7. Liability and Disclaimers
We are not liable for any damages, injuries, or losses arising from the services provided by the Drivers. The Drivers are solely responsible for their actions and the quality of the services they provide.
We do not guarantee the availability or accuracy of the information on our Platform and are not responsible for any errors or omissions.

8. Changes to Terms
We may update these Terms from time to time. Any changes will be posted on our Platform, and your continued use of the Service after such changes constitutes your acceptance of the new Terms.

9. Governing Law
These Terms are governed by the laws of Sultanate of Oman, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of Sultanate of Oman.
